fa مبانی اخلاق قانونگذاری از منظر مقاصد الوحی در اندیشه شاطبی قانون‌گذار آرمانی مد نظر ما کسی است که در هنگام تشریع و قانون‌گذاری، ادب، اخلاق و اصول قانون‌گذاری را رعایت کند.پژوهش حاضر با تکیه بر نظریه مقاصد شریعت در اندیشه امام شاطبی، به بررسی مبانی اخلاق قانون‌گذاری می‌پردازد. شاطبی با تأکید بر مقاصد خمسه ـ حفظ دین، جان، عقل، نسل و مال ـ چارچوبی اخلاقی و عقل‌پسند برای تشریع ارائه می‌دهد که قانون‌گذار را در خدمت مصلحت عمومی قرار می‌دهد. تمایز او میان عبادات و معاملات، جواز قیاس در امور معقول‌المعنی، و تحلیل تفاوت آیات مکی و مدنی، نظامی پویا از اصول ثابت و متغیر شریعت را ترسیم می‌کند. بر پایه تقدم نقل بر عقل، شاطبی قانون‌گذاری را فرایندی اخلاقی می‌داند که باید در چارچوب حدود شرعی و مصالح انسانی سامان یابد. این رویکرد می‌تواند مبنایی برای قانون‌گذاری اسلامی در مواجهه با چالش‌های اخلاقی، اجتماعی و فناورانه معاصر فراهم آورد. The ideal legislator in this study is one who upholds propriety, ethics, and the principles of legislation.This study examines the ethical foundations of legislation through Imām al-Shāṭibī’s theory of Maqāṣid al-Sharīʿah. By emphasizing the five objectives—preservation of religion, life, intellect, lineage, and property—al-Shāṭibī formulates a moral and rational framework that places legislation in service of the public good. His distinction between devotional acts and transactions, acceptance of analogy in rational matters, and differentiation between Meccan and Medinan revelations establish a dynamic balance between fixed and adaptable Sharīʿah principles. Grounded in the precedence of revelation over reason, al-Shāṭibī views lawmaking as an ethical process bound by divine limits and human welfare.
